Add manager(s) hospitality business

You make the application to add an executive on the appendix to the Alcohol Act license and/or the exploitation license catering separately. Has this application reached us? You will receive a provisional grant for this person. Then the person may work as a manager within your catering establishment. 

Cost

The cost of changing manager(s) where alcohol is or is not served (operation with alcohol or alcohol-free operation) is in 2024:

  • € 156.05 for the first executive
  • € 99.25 for each subsequent executive

Description

We first check whether the person meets the age requirement ( 21 years for the Alcohol Act license and 18 years for the operating license for the catering industry ), before you receive the provisional grant. Does a catering establishment require an Alcohol Act license and a catering operating license? Then the age limit of 21 years applies. We also check whether the person has the social hygiene diploma.

Is the application not submitted completely? Then we will indicate this in the provisional award. Your application must be complete within the specified period, otherwise this person may no longer work as a manager in your hospitality business.

Even if the person in question does not meet the requirements of the Alcohol Act and/or the General Local Bye-Law (APV), this person must immediately cease working as a manager. The requirements set are for example: good conduct of life, meet the morality requirements, meet the requirements of the laws and regulations of Bibob and are not under guardianship.

We will let you know by letter. This person must then immediately terminate their work as a supervisor.  

Note: If you report an executive who does not meet the requirements 3 times within 2 years, we may revoke your license. 

Terms

  • Attach a copy of a valid employment contract, a copy of the social hygiene diploma and a copy of a valid passport or identity card to the application for the addition of an executive. 
  • A manager must be at least 21 years old for the Alcohol Act license (catering business where they serve alcohol/ liquor business) and at least 18 years old for the operating license (catering business) (business where they do not serve alcohol).
  • The Alcohol Act license, the operating license (catering industry), the accompanying appendices and the provisional grant must be present in your catering establishment. You must be able to show this during an inspection. If the procedure is completed positively, we will add the manager to the appendix. The provisional award will then expire. 
  • All operators and managers of the catering establishment must have a social hygiene diploma from the Alcohol Act license. 
  • During the opening hours of the catering establishment, 1 of the managers must always be present.
  • A supervisor must meet several requirements. For example, a supervisor may not be of bad character (we check this through a background check) and he may not be under guardianship.

Term

If your application is complete and there are still no grounds for refusal, you will receive the provisional award from the municipality within a few days.

Objection and appeal

You can object to the municipality's decision.

If you disagree with the ruling on the appeal, you can appeal to the court.
