The municipality regularly sells real estate such as homes, buildings or social facilities. But they may also be undeveloped pieces of land or residual strips. These sales must be publicly disclosed.
If a municipality wants to sell real estate, it should act transparently and publish it online in advance. This way, interested parties can let it be known that they are interested and compete for that property. The publication is necessary if several candidates are expected to come forward. The buyer must be selected by the municipality based on pre-established criteria.

If only one particular party is expected to qualify, the above is not required. These are the so-called 1:1 sales. Only the sale must then be published with reasons. This new method of sale is stipulated in a ruling by the Supreme Court on November 26, 2021; the so-called Didam ruling.
