Municipal land use (temporary)

Do you want to place something on municipal land, such as an aerial platform, container or scaffolding? Then ask for permission first.

Approach

This is how you request permission to use municipal land: 

  • You apply for permission online. To do this, log in with your own DigiD (also as a company).
  • You pay for the application with iDeal.

Cost

The cost of a permit is from €19.60 (rate 2024)

Without the Chamber of Commerce number in the application form (if the applicant is an organization or company), as the applicant, you pay the fees yourself.

Description

Residents, companies or institutions can use municipal land. If you want to organize something on municipal land, you need permission from municipality. If you receive permission, you may use the land under certain conditions. The municipality remains the owner of the land.

Terms

Do you want to place objects along the side of the road or on the sidewalk? Always apply for a permit for temporary use of municipal land. Even if the sidewalk is private property, but has a public character.
Among other things, you will not receive a permit for placing an object: 

  • in public greenery
  • On the roadway where a stop is prohibited
  • playground, sandbox or playing field
  • in a handicapped parking space
  • at a fire hydrant (both above and below ground)

Notice:

  • you must not damage the road surface
  • escape routes must remain clear
  • the passage for emergency services must be at least 3.50 meters wide
  • You should never place a container on the sidewalk

Are you going to place objects on municipal land for work that also requires another permit?
For example, an environmental permit to build or demolish? Then you may not carry out the work until you have also obtained the other permits.permits.
Keep this in mind when planning the placement of containers, aerial platforms, etc..

The municipality decides on the basis of the Development Decree.

Term

Apply for the permit at least 2 weeks in advance. We need this time to prepare your application.

The municipality will decide on your application within 8 weeks. Is this not possible? Then the municipality may extend this period 1 time.

Objection and appeal

Do you disagree with the municipality's decision? Then you can file an objection. With this you let the municipality know why you disagree with the decision. Do this within 6 weeks. The municipality will review your application and make a new decision.

After that, if you still don't agree with the decision of municipality? Then you can ask the court if the municipality made a good decision. This is called "appeal.
