Requesting an exemption for noise pollution during construction and demolition

If you want to build, remodel or demolish, you must follow rules about noise. Do you want to make loud noise for a long time or outside the times that this is allowed? Then you can apply for an exemption from the municipality.

Did you apply for a waiver in 2023? If so, different rules may apply to you.

Approach

Contact the municipality to discuss your plans. Do this well before you apply for the waiver. That way your application will have a better chance of success.

This is how you apply for the noise waiver:

  • Go to the Environment Counter.
  • Do the permit check.
  • You will see if you need a waiver. You can apply for the waiver right away.
  • Log in:
    • for yourself: with DigiD
    • For a company: with eRecognition
  • You pass on:
    • In which area you want to perform the work and what is the distance from the nearest homes and other noise-sensitive buildings such as hospitals, nursing homes and schools.
    • How and with what you intend to carry out the work.
    • What measures you are taking to reduce noise pollution.
    • How to inform local residents about noise pollution.
    • How and to whom nuisances can be reported.

Description

You may perform commercial construction or demolition activities with a noise level of 60 dB(A) or higher only on weekdays and Saturdays between 7 a.m. and 7 p.m. You have obtained an environmental permit for these construction or demolition activities. There is a maximum number of days on which you may produce this noise level. The maximum number of days depends on the number of dB(A):

  • 60-65 dB(A): a maximum of 50 days
  • 65-70 dB(A): up to 30 days
  • 70-75 dB(A): maximum 15 days
  • 75-80 dB(A): up to 5 days
  • above 80 dB(A): is not permitted; 0 days

You can apply for a waiver at municipality if you:

  • Want to perform construction and demolition work on weekdays and Saturdays between 7 p.m. and 7 a.m.
  • want to perform construction and demolition work on Sunday or a holiday
  • want to extend the maximum number of days on which you may make noise of 60 or more dB(A)
  • want to use devices that operate day and night, such as a groundwater pump

Are you going to perform work with (construction) machinery outside the establishment in the open air? And will you cause noise pollution for local residents or other surroundings? Then you must apply for an exemption from the municipality. 

Terms

The conditions for applying for a waiver are:

  • You use the quietest techniques and materials.
  • You partition the construction site so that noise pollution is limited.
  • You ensure that the noise disturbance is as short as possible.
  • You inform local residents in a timely manner about planned work.

Term

The municipality decides within 8 weeks of receiving your application. The municipality may extend this deadline once.

Objection and appeal

You can object to the decision on your application. Do this within 6 weeks. Do you then disagree with the decision on the objection? Then file an appeal with the court.
