Buy a home and rent it out immediately

In many neighborhoods in Heerlen, you cannot simply buy a house and rent it out immediately. You need a permit to do so. You will only be granted this permit if you meet the Requirements.

What do you need?

You will always need the following documents and information for an application:

  • The current WOZ value of the property. You can find this value on your WOZ assessment. Or find the value on the 'wozwaardeloket
  • The deed of transfer for the property.

Sometimes you may also need one or more of the following documents:

  • When applying to rent to a family member, documents proving the family relationship, for example:
    • birth certificate(s) extract
    • marriage certificate extract
    • proof of registered partnership
    • proof of adoption

  • If you want to rent out the property for a maximum of one year, for example because you want to spend a year abroad:
    • a one-year rental agreement with the details of the person/household to whom you are renting.

  • In the case of a permit for the rental of residential space that is inextricably linked to a shop, business, or office space:
    • an extract from the Chamber of Commerce for the company located in the shop, business, or office space, and
    • a site plan showing that the dwelling is inextricably linked to the commercial space.

  • When applying for an exemption from the rental ban, you must submit documents that support why you should be eligible for an exemption. This could include proof of the social purpose for which you are applying for the exemption.

You do not need a permit for these neighborhoods if:

  • you must first live in your home for four years. After that, you may rent out the home without a permit;
  • the previous owner had already rented out the property for a period of 6 months or longer and the property was in a rented state when you became the owner;
  • you are a housing association and use the property for social housing, or;
  • the property has a WOZ value of more than €300,000 at the time you became the owner.

Requirements

You will receive a permit for purchase protection from the municipality if:

  • You rent out the property to a family member. For example, to your child, parent, grandparent, brother, or sister.
  • The property belongs to a permanent business premises, such as a shop or an office.
  • You are renting out your home temporarily:
    • You have lived in the property for at least 1 year.
    • You may rent out the property for a maximum of one year.

When does the municipality decide whether you will be granted a permit?

  • You purchased the property on behalf of the municipality.
  • As a healthcare organization, you rent the home to someone who Health .
  • The property was purchased by a housing association or a developer working for the municipality.

Term

The municipality will make a decision within 8 weeks of receiving your application. The municipality may extend this period once by 6 weeks.

Objections and appeals

You can object to the decision on your application. Do this within 6 weeks. If you disagree with the decision on the objection, you can lodge an appeal with the court.
