Buy property and rent it out immediately

In some neighborhoods in Heerlen you are not allowed to buy a property and rent it out immediately. If you want to rent out a house in such an area and no exception applies to your situation, you need a permit. You apply for this permit at the municipality.

What do you need?

For an application, you will always need the following documents and information:

  • The current WOZ value of the property. You can find this value on your WOZ assessment. Or find the value on the 'wozwaardeloket
  • The deed of delivery of the property.

Sometimes you may also need one or more of the following documents:

  • When applying to rent to a family member documents to prove the family relationship, for example:
    • excerpt of birth certificate(s)
    • excerpt of marriage certificate
    • proof of registered partnership
    • proof of adoption

  • If you want to rent out the property for up to 1 year, for example, because you want to spend a year abroad:
    • A 1-year rental contract with the details of the person/household to whom you will rent.

  • In the case of a permit for rental of residential space that is inseparable from retail, commercial or office space:
    • an extract from the Chamber of Commerce of the company located in the store, business or office space, and
    • A situational drawing showing that the dwelling is inseparable from the premises.

  • When applying for a rental ban exemption, you must include documents that support why you should be considered for an exemption. Consider, for example, evidence of the social purpose for which you are applying for the waiver.

You do not need the permit for these neighborhoods if:

  • you first live in your home yourself for 4 years. After that, you may rent out the property without a permit
  • the previous owner already rented the property for a period of 6 months or more
  • you are a housing association and use the property for social renting
  • the property has a WOZ value of more than €300,000 at the time you became an owner

You do not need a permit in these neighborhoods in Heerlen. You do not have to meet the conditions.

Terms

In these situations, you can apply for a rental permit buyout protection:

  • You rent the property to a family member in the 1st or 2nd degree, for example, a child, parent, grandparent, brother or sister.
  • The property belongs to a fixed business area, such as a store or office.
  • You rent out your property temporarily:
    • You have lived in the property yourself for at least 1 year.
    • You rent the property for up to 1 year.
  • You bought the property on behalf of the municipality.
  • You are a care provider and you rent the property to someone who needs care.

Term

The municipality decides within 8 weeks of receiving your application. The municipality may extend this period once by 6 weeks.

Objection and appeal

You can object to the decision on your application. Do this within 6 weeks. Do you then disagree with the decision on the objection? Then file an appeal with the court.
