If you disagree with a plan or decision of the municipality, you can submit your views. You can send your views by mail or orally to the municipality.

For example, you can submit your views if a new zoning plan is given for the parcel where you live and you disagree with it.

Approach

You can submit your views in writing or orally. It can be oral only if it is indicated in the publication.

This is how you submit your views orally:

  • Make an appointment at the municipality.
  • Submit your views.
  • The municipality will make a record of your oral views.
  • You sign the report.
  • The municipality will send you a personal message with the final decision.

This is how you submit your views in writing:

  • Send your views to the municipality. This will state:
    • your name and address
    • the plan or decision with which you disagree. For example, include a copy of the draft or write down the case number.
    • Why you disagree with the draft or decision
    • the date you write the view
    • your signature
    • possibly a written authorization with signature
  • You will receive an acknowledgement of receipt of your written views.
  • The municipality will send you a personal message with the final decision.

Description

Sometimes the municipality has a plan or makes a decision with which you disagree. You can then give your opinion. This is called an opinion. For example, you can give your opinion if someone wants to cut down a monumental tree and you do not agree. Or maybe you disagree with a new environmental plan of the municipality.

You can only submit a view on draft decisions and draft plans. These are plans that have not yet been approved. The municipality announces new plans or decisions via the website and door-to-door newspapers. The municipality can then adjust the decision. The municipality can adopt your opinion in the final decision. But it doesn't have to. Several people may be affected by the plan or decision. The municipality looks at their interests and then makes a decision.

  • And/or sends them to the person affected (the interested party).

Terms

The conditions for submitting a view are:

  • It is a view on draft decisions or draft plans.
  • You must submit your views within 6 weeks of publication of the decision or plan.
  • someone else can submit your views on your behalf, for example:
    • a lawyer either
    • a person you have authorized to do so for you.

Objection and appeal

Once you have given your views, you can appeal the final decision. You appeal to the court. Does it concern an environmental plan? Then you appeal to the Council of State.

You have 6 weeks to file the appeal.
