Divorce or termination of registered partnership

You file for divorce at the court. You terminate a registered partnership through a lawyer or notary. Do you have minor children or do you disagree with each other? Then you must go to court. The lawyer or notary will report the termination to the municipality.

Usually, your lawyer or notary will report the divorce or termination of a registered partnership to the municipality. You or your former partner may also do this yourself. If you choose to report it yourself, please contact us by telephone first.

Approach

How to report a divorce:

  • You file for divorce in court. You will need a lawyer for this.
  • The lawyer submits a request to the court.
  • Your lawyer will send the court's decision to the municipality. You can also report this to the municipality yourself. Your former partner may also do this. You must do this at the municipality where you were married.
  • You send the following documents to the municipality:
    • a written request for registration in the civil registry
    • proof of the court's decision (the divorce decree)
    • proof that you are not appealing against the court's decision (the deeds of acquiescence)

How to terminate a registered partnership through a notary or lawyer:

  • You go to a notary or lawyer.
  • You draw up an agreement together about ending the partnership.
  • The notary or lawyer reports the agreement to the municipality.
  • The municipality processes the agreement in the civil registry.

Requirements

  • You do not have any children under the age of 18.
  • You both want to terminate the registered partnership.

Term

You must file for divorce within 6 months of the final court decision.

The agreement to terminate a registered partnership (via a notary or lawyer) must be registered with the civil registry office within three months. A court ruling must be registered with the civil registry office within six months.
