Divorce or termination of registered partnership

You file for divorce with the court. You end a registered partnership through a lawyer or notary public. Do you have minor children or do you disagree? Then you have to go to court. The lawyer or notary will report the termination to the municipality.

Usually, your lawyer or notary public reports the divorce or termination of registered partnership to the municipality. You or your former partner may also do this yourself. If you choose to report it yourself, please contact us by phone first.

Approach

This is how you report a divorce:

  • You are filing for divorce with the court. You will need a lawyer to do this.
  • The lawyer makes a request to the court.
  • Your lawyer will send the court's decision to the municipality. You can also notify the municipality yourself. Your former partner may also do this. You do this at the municipality where you were married.
  • You will send the following documents to the municipality:
    • a written request for entry in the register of civil status
    • proof of the court ruling (the divorce decree)
    • proof that you are not appealing the judge's decision (the deeds of acquiescence)

This is how you end a registered partnership through a notary or lawyer:

  • You go to a notary or lawyer.
  • Together, you draft an agreement about ending the partnership.
  • The notary or lawyer reports the agreement to the municipality.
  • The municipality processes the agreement in the registers of civil status.

Communicating the notification is free of charge. You agree on the cost of an attorney with the law firm.

Requirements

The Requirements to end a registered partnership through a notary or lawyer are:

  • You have no children under the age of 18.
  • You both want to end the registered partnership.

Term

You must file the notice of divorce within 6 months of the judge's final decision.

The agreement ending registered partnership (via notary or lawyer) must be registered with the civil registry within 3 months. A court order must be registered with the civil registry within 6 months.
